Intellectual property rights are territorial. An EU trademark does not automatically extend to Kosovo, and a patent registered in Germany does not protect your invention in Kosovo. EUIPO (EU Intellectual Property Office) registrations do not extend to Kosovo. If you have an EU trademark and want protection in Kosovo, you must file separately with KIPA. I advise international clients on whether Kosovo-specific filings are necessary for their business.

2022 Trademark Law Update: Kosovo's trademark legislation was aligned with EU Directive 2015/2436, improving enforcement mechanisms and modernising registration procedures. The 2023 administrative instructions further clarified the treatment of well-known marks.

Patents protect inventions that are novel, involve an inventive step, and have industrial applicability. In Kosovo, patent applications are filed with KIPA.

Priority claims: If you have filed a trademark or patent application in another country within the past 6 months (trademarks) or 12 months (patents), you may be able to claim priority in Kosovo based on your earlier filing.
