Established in 2022, the Commercial Court of Kosovo handles business disputes in first and second instance. This includes:

The Commercial Court provides faster, more consistent case management than the general civil courts for business matters.

Non-commercial civil disputes are handled by the Basic Courts under the Law on Contested Procedure (Law No. 03/L-006). These courts handle personal injury, family law, property, and other non-commercial matters through standard civil procedure: written pleadings, preparatory hearings, main hearing, judgment, and appeals.

Kosovo's mediation framework is governed by Law No. 06/L-009, aligned with EU Directive 2008/52/EC. Mediation is:

• Voluntary in most matters, but partly mandatory: under Article 9 the court must refer parties to mediation in certain family disputes (alimony, custody, contact, child support, and division of marital property) and in property disputes over servitudes and expropriation
• Confidential: statements made during mediation cannot be used in court
• Available before or during litigation
• Produces binding settlement agreements when signed by both parties

Mediation is often the fastest route to resolution. A mediated settlement can be reached in weeks rather than the months or years required for court litigation.

Kosovo's arbitration framework is governed by Law No. 02/L-75 (Law on Arbitration). Arbitration offers:

• Confidential proceedings (unlike public court hearings)
• Enforceable awards: both domestic and foreign arbitral awards are enforceable in Kosovo
